Sense Limited Warranty

This Limited Warranty and Limitation of Liability applies to all Soteria Sense devices and associated hardware, firmware, and software. Please review these terms before purchasing, installing, or using the product.

Overview

This Limited Warranty and Limitation of Liability statement applies to the Soteria Sense monitoring device, including associated hardware, firmware, and software provided by Soteria (collectively referred to as the “Product”). By purchasing, installing, or using the Product, the user agrees to the terms described in this document.

Definitions

"Original Purchaser" means the individual or entity that purchased the Product directly from Soteria or an authorized Soteria distributor or reseller.

"Product" means the Soteria Sense device, associated firmware, embedded software, and accompanying documentation supplied by Soteria.

Limited Product Coverage

2.1 Warranty Coverage

Soteria warrants that the Product will:

Be free from defects in materials and workmanship, and
Perform substantially in accordance with the published product documentation,

when used under normal operating conditions and in accordance with Soteria’s installation and operating instructions.

This warranty applies only to the original purchaser or authorized customer of the Product.

2.2 Warranty Period

The Product is covered by this limited warranty for a period of:
Twenty-four (24) months from the date of shipment or thirty (30) months from manufacture, whichever occurs first.

2.3 Warranty Remedies

If a defect covered by this warranty is reported during the warranty period, Soteria may, at its sole discretion:

Repair the defective Product
Replace the Product with a new or refurbished equivalent product
Replace defective components
Refund the purchase price of the Product

Any replacement Product may contain refurbished or equivalent components.

The remedies described above constitute the sole and exclusive remedy for any breach of warranty.

Warranty Exclusions

This warranty does not cover:

Damage resulting from misuse, abuse, neglect, improper installation, or unauthorized modifications.
Operation outside published environmental specifications, including exposure to water, oil, corrosive chemicals, excessive humidity, or temperatures outside the specified operating range.
Damage caused by external events including fire, flooding, electrical surges, mechanical damage, or transportation incidents occurring after delivery.
Normal aging, calibration drift, or degradation of gas sensing elements after the warranty period.
Consumable or wear-related degradation associated with long-term sensor exposure to contaminants or harsh environments.

Soteria recommends periodic verification of sensor operation and replacement or recalibration of sensing elements after approximately five (5) years of service to maintain specified detection performance.

User Responsibilities

The user is responsible for:

Installing the Product according to Soteria’s documentation
Maintaining appropriate environmental and operating conditions
Ensuring reliable power and network connectivity
Following recommended maintenance and firmware update procedures

Failure to comply with these responsibilities may void the warranty.

Product Use Limitations

Soteria Sense is intended as an early warning device for lithium-ion battery venting and off-gassing events and is designed to provide additional time for user response prior to potential thermal runaway events. Detection performance is dependent upon battery chemistry, state of charge, vent gas composition, airflow conditions, environmental contaminants, installation location, and other operating variables. Due to variations in battery chemistry, vent gas composition, airflow, environmental contaminants, and installation conditions, the Product may generate false positive alerts or may fail to detect certain battery failure events. The Product does not prevent thermal runaway, battery fires, explosions, toxic gas release, or property damage and should not be interpreted as eliminating or materially reducing these risks. The Product is not a fire alarm, smoke detector, combustible gas detector, explosion prevention system, or fire suppression device and shall not be relied upon as the sole means of fire protection, hazard mitigation, life safety monitoring, or regulatory compliance. Users remain responsible for implementing appropriate fire detection, fire suppression, ventilation, emergency response procedures, and all applicable building and safety code requirements.

Sensor Accuracy & Data Disclaimer

Sensor readings and data generated by the Product may be affected by factors including:

Environmental conditions
Sensor calibration drift
Installation conditions
Network interruptions

Soteria does not guarantee absolute accuracy, continuous monitoring, or uninterrupted data transmission.

The Product should not be used in applications where sensor inaccuracies could reasonably be expected to result in personal injury, loss of life, or significant property damage without appropriate secondary safety systems.

Connectivity & Software Services

Certain Product features may depend on:

Internet connectivity
Cloud services
Mobile applications or third-party platforms

Soteria does not guarantee continuous or uninterrupted availability of these services. Service interruptions may occur due to:

Network outages
Maintenance
Software updates
Third-party service disruptions

Hydrogen Sensor Transition Program

The first one hundred eighty (180) production units of Soteria Sense are shipped without an integrated hydrogen (H₂) sensor and rely on carbon dioxide (CO₂), volatile organic compound (VOC), temperature, and humidity sensing technologies for battery vent event detection.

Soteria intends to provide a replacement program for eligible first-generation units incorporating hydrogen sensing capability when commercially available. Program eligibility, timing, and implementation details will be determined by Soteria and communicated to original purchasers.

Wireless Certification Statement

The first one hundred eighty (180) production units are pre-certification units and may not carry FCC, Industry Canada, CE, or other market-specific wireless approvals applicable to later production models. Production units manufactured after the first one hundred eighty (180) units are expected to comply with applicable wireless regulatory requirements for their intended markets.

No Life Safety Certification

Soteria Sense is not certified as a fire alarm, smoke detector, combustible gas detector, hazardous location detector, life safety device, or emergency notification system under any UL, FM, NFPA, or equivalent life safety standard unless explicitly identified in product documentation.

The Product is not intended to satisfy building code requirements or replace any code-required fire detection, fire suppression, or life safety equipment.

Disclaimer of Warranties

Except for the limited warranty expressly stated in this document, the Product is provided “AS IS” and “AS AVAILABLE.”

To the maximum extent permitted by law, Soteria disclaims all other warranties, whether express, implied, or statutory, including:

Implied warranties of merchantability
Implied warranties of fitness for a particular purpose
Warranties arising from course of dealing or usage of trade

Limitation of Liability

To the maximum extent permitted by applicable law, Soteria Battery Innovation Group shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the installation, operation, malfunction, delayed response, false alarm, failure to alarm, or inability of the Product to detect a battery failure event. Soteria's total cumulative liability arising from any claim related to the Product shall not exceed the original purchase price paid for the Product giving rise to the claim.

Indemnification

The user agrees to indemnify, defend, and hold harmless Soteria, its affiliates, officers, employees, and partners from and against any claims, damages, liabilities, losses, or expenses arising from:

Improper installation or use of the Product
Modification or misuse of the Product
Failure to follow instructions or safety procedures
Use of the Product in violation of applicable laws or regulations

Warranty Claims Process

To submit a warranty claim, customers must:

Contact Soteria customer support at [support email / website]
Provide proof of purchase and product serial number
Provide a description of the issue
Obtain a return authorization if requested

Products returned without authorization may not be accepted. Any claim arising under this warranty must be submitted within thirty (30) days of discovery of the alleged defect and in no event later than ninety (90) days following expiration of the applicable warranty period.

Governing Law & Venue

This Agreement shall be governed by the laws of the State of South Carolina without regard to conflict of laws principles.

Any action arising under this Agreement shall be brought exclusively in the state or federal courts located in South Carolina.

Changes to Warranty Terms

Soteria reserves the right to modify warranty terms for future products and future sales.

The warranty terms in effect at the time of purchase shall govern the Product for the duration of the applicable warranty period.

Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Reservation of Rights

Soteria reserves the right to improve, revise, modify, or discontinue the Product and its specifications without prior notice. Product specifications, sensing capabilities, certifications, and features may vary by manufacturing revision and production date.
